REGARDING THE INFORMATION SOCIETY SERVICES OF WWW.MITP.MD
1. Definitions
- Client – Any natural person / legal entity who has or obtains access to the www.mitp.md website from any communication device (phone, tablet, PC, laptop, etc.) and who wishes to become a resident of the park (Moldova IT Park).
- User – Any natural person / legal entity registered on the website who completes the Account creation process.
- Account – A section of the Website consisting of an email address and a password that allows the Client to submit the request to become a resident member of Moldova IT Park and contains information about the Client/Resident and the history of activities in the personal dashboard (these may include, but are not expressly limited to, submitting the application to become a Moldova IT Park member, changing status, modifying data, subscribing to additional services such as IT Visa, courses, trainings, etc.).
- Park Resident Application – An electronic document through which the Client requests from the Service Provider (Moldova IT Park), via the Website, the intention to benefit from the services provided on the website, allowing a form of communication between the parties.
- Contract – A distance contract concluded between the Service Provider and the Beneficiary.
- Content – Information that can be viewed or accessed by using electronic equipment.
- Park Resident – A legal entity or natural person registered in the Republic of Moldova as a business entity, included in the Register of Park Residents, and practicing as its main activity one or more activities provided for in Art. 8, based on a contract concluded with the Park Administration;
2. Service Provider
2.1 Moldova IT Park, as an administrative authority established by the Government, is registered as a public law legal entity (hereinafter referred to as the personal data operator), IDNO - 1017601000172, with its registered office located at 38 S. Lazo St., Mun. Chisinau, Republic of Moldova, operating in accordance with the provisions of:
- Law No. 77/2016 on Information Technology Parks;
- Government Decision No. 1144/2017 on the creation of the "Moldova IT Park" Information Technology Park;
- Other regulatory acts.
3. Who Can Use the Website
3.1 Access may be carried out by any natural person or representative of a legal entity, in their own name.
3.2 The activities carried out by the operator are intended for resident persons of the Republic of Moldova, or, where applicable, other persons in connection with the scope of activity of Moldova IT Park.
3.3 All information accessible on the website concerning text content, images, structure, etc., is intended exclusively for natural persons/legal entities for personal use and is protected in accordance with national legislation on copyright and related rights. Any copying or utilization of this information for purposes other than the stated one is prohibited and entails liability in accordance with the legislation in force.
4. Authentication Method in the System
4.1 Registration in the system is performed by accessing the website www.mitp.md, and it is necessary to record the following categories of data:
- For the "Sign in" option: Electronic signature (mobile signature, electronic signature, electronic ID card, 2-step authentication) MPass – a governmental functionality managed by the e-Governance Agency;
5. Intellectual Property Rights and Content
5.1 The website www.mitp.md is the property of Moldova IT Park. The website is intended for the registration of companies intending to become resident members of the park via the www.paap.mitp.md platform. The content of www.mitp.md, including but not limited to logos, stylized representations, commercial symbols, static images, dynamic images, text, and/or multimedia content presented on the Website, is the exclusive property of Moldova IT Park, with all rights granted by law directly or indirectly (via usage and/or publication licenses) being reserved.
5.2 The Beneficiary is not permitted to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, or include any content in any context other than the original one intended by Moldova IT Park, include any content outside the Website, remove copyright notices of Moldova IT Park regarding the content, nor participate in the transfer, sale, or distribution of materials produced by reproducing, modifying, or displaying the content, except with the express written consent of Moldova IT Park. Any content to which the Beneficiary has and/or obtains access by any means is subject to the General Conditions, unless the Content is accompanied by a specific and valid Use Agreement concluded between the company and the Beneficiary, and without any implicit or explicit guarantee from Moldova IT Park regarding that content.
5.3 No Content transmitted to the Beneficiary through any means of communication (electronic, telephone, etc.) or acquired by them through access, visiting, and/or viewing constitutes an obligation on the part of Moldova IT Park and/or the employee/agent who mediated the Content transfer, if any exists, with respect to the respective content. Any use of the Content for purposes other than those expressly permitted by these Terms and Conditions or by the accompanying use agreement (if any) is prohibited.
6. Disclaimer of Liability
Moldova IT Park does not guarantee that the website, the servers on which it is hosted, or emails sent from Moldova IT Park are free of viruses or other potentially harmful computer components, that it contains no omissions, defects, operational or transmission delays or interruptions, line failures, or similar factors.
7. User Registration
The Client has the option to create an account on www.mitp.md by providing: Personal account login; Personal account password; Email; Phone; Profession/Company Position; MPass electronic signature.
8. Privacy Policy
Moldova IT Park will make maximum efforts to ensure that any confidential information with, about, and in connection with any account opened on www.mitp.md remains confidential, except for data that, according to the law, must be exposed to public access, such as: company name and status, legal address, contact data regarding the Moldova IT Park residency status. Transmitted information will be treated as confidential information and must be used solely for the purpose for which it was transmitted and must not be used for other purposes without your written consent, unless:
a) it was known by the receiving party before being brought to its attention by the disclosing party through a public channel, thus becoming public information;
or
b) its disclosure is required by applicable law, court decision, or competent authorities.
9. Fraud
Moldova IT Park will at all times take all measures provided by Law to notify the authorized bodies regarding potential fraudulent actions, including money laundering activities.
10. Limitation of Liability
Moldova IT Park may modify the Terms and Conditions of the website www.mitp.md at any time, with the new provisions becoming public and enforceable against clients from the date of their upload onto the website.
